Privacy Policy
We apologize in advance if this seems a bit long. We think so too. Our lawyers made us say this. But we do want you to read it, so that you will understand what we do with your personal information.
HOPNBR Inc. cares about your privacy and is compliant with privacy regulations. We will not share your personal information with any third party except
• as you authorize
• as described in the relevant portion of HOPNBR’s mobile application (the “App”)
• to provide you HOPNBR loyalty benefits, products and/or services (the “HOPNBR Benefits”)
• to allow you to pay your bar or restaurant bill
• to the extent you make any use of any of HOPNBR’s loyalty programs, to merchants with which HOPNBR has a business relationship for the fulfillment of loyalty rewards
• as may be required by law or court order
• as set forth in this Privacy Policy or the HOPNBR Terms of Use
BY SUBMITTING ANY PERSONAL INFORMATION TO HOPNBR, YOU ARE ACKNOWLEDGING THAT YOU CONSENT TO WHAT WE DO WITH YOUR INFORMATION. IF YOU DO NOT AGREE TO BE BOUND BY THIS PRIVACY POLICY (which is cool, but we’ll miss you), SIMPLY EXIT THE APP WITHOUT ACCESSING OR USING ANY OF HOPNBR’S SERVICES.
Children under 16 are not eligible to obtain any HOPNBR Benefits and HOPNBR will not knowingly collect personal information from or about children under 16. If you are under 16, please don’t use the App and please don’t try to fool us and tell us you are older. We were kids once too, and we know how much fun it is to fool adults.
1. About HOPNBR
HOPNBR operates the App to provide HOPNBR Benefits to you, administer certain rewards and/or loyalty programs for both you and bar and restaurant operators (“Operators”), and allow these Operators to communicate with you, including by sending you commercial electronic messages.
For example, an Operator may push out a message that a certain drink or food item has a discounted price for a period of time. If you agree to receive such a message, you will find out about the discount. Otherwise, you may not find out about it.
You will always have the right to unsubscribe from messages from that particular Operator, but doing so will not result in your unsubscribing from messages from other Operators. If you unsubscribe from a particular Operator’s messages, you will not get another one from that Operator again unless you re-subscribe.
Using the functionality of the App, you can selectively allow commercial messages from some Operators but disallow commercial messages from other Operators. You can’t unsubscribe from receiving the bill for your bar tab, of course. No surprise there, but nice try.
2. Information We Collect
You will be asked, when visiting the App, to enter personal information. This information will include your:
• name and address
• email address
• phone number (to verify who and where you are and for text messaging until you unsubscribe)
• credit card information (so that you can pay your bar or restaurant bill)
• birthday (a legal requirement, because of regulated products that Operators may sell through the App)
• information respecting your preferences concerning HOPNBR Benefits and communications from both HOPNBR and Operators
When you use the App, HOPNBR automatically receives and records information on our server logs from your mobile phone, including your IP address, physical location and movements from place to place. HOPNBR also collects and uses information such as transaction location, purchase activity, browser open date and time, idle time, and all clicks and/or swipes within the App (together with time and order). HOPNBR may also collect information posted on social media sites if you choose to connect to or link the HOPNBR App or log in with social media accounts such as LinkedIn, Facebook and Twitter. We treat this particular data as non-personal information for purposes of operating the App, except where we are required to treat it as personal information under applicable law. HOPNBR may sell, disclose or otherwise use certain non-sensitive information gathered via the App to third parties on an aggregated (anonymous) basis.
We want to make sure that we are providing you the best possible experience with our App. So we collect and track certain user information. When you use the App, our Web server may send a cookie to your mobile device. This cookie will store a limited amount of information about your App visit and tracks aggregate information on how our site is being used, including session counts, navigation patterns, pages visited, etc. These cookies, however, do not store any personally identifiable information such as your name, email address or phone number as you browse. If you submit a question or otherwise interact with the App, we store your cookie identification in our system. This cookie allows us to recognize you when you return. HOPNBR may also utilize Web Logs to track aggregate information such as the number of visitors, operating systems, Internet service provider addresses (if available), and browser type. Unlike cookies, Web Logs are maintained only on HOPNBR servers and do not store or place anything on the user’s mobile device.
If you come to our App from an online banner ad, an anonymous identification number may be passed to the App. This information cannot be used to gather any personally identifiable information about you. It will only allow us to track the overall effectiveness of online advertising, marketing and banner advertisement campaigns.
HOPNBR may also collect device-specific information (such as your mobile device model, operating system version, unique device identifiers – i.e., IMEI, MEID or UDID – and mobile network information including phone number).
When you use the App, we are required collect and process information about the actual bar or restaurant in which you are located. We may also use various technologies to determine location, some of which may be made available through third party licensors.
You may have the option of completing an online survey at the App from time to time. Participation in surveys is completely voluntary and it is your choice whether or not you wish to disclose your personal information to us in connection with any such survey.
We may collect information via the “Contact Us” section of the App. You may contact HOPNBR through the “Contact Us” feature. Participation in this area is completely voluntary and it is your choice whether or not you wish to disclose your personal information to us.
3. How Your Information Is Used and Disclosed
We use the information you give us to provide you with HOPNBR Benefits, either directly or through third party service providers. Some of our HOPNBR Benefits may be offered in conjunction with partner companies, affiliates or other companies, websites or apps with which our App interacts. In order for us to provide the HOPNBR Benefits to you, it may be necessary for us to share your personal information, including your location and movements, with them. These parties are not allowed to use personally identifiable information except for the purpose of providing the HOPNBR Benefits. If you do not want your data to be shared, you can choose not to obtain the HOPNBR Benefits and not to interact with our App.
To the extent that there are social media elements to the HOPNBR App, some information about you may be shared with members of the public who are near you or who frequent the same bars and restaurants that you attend. That’s part of the fun of using the App.
Please take note that we are obliged to collect personal information, from both you and third party processors, for purposes of enabling payment to Operators.
In addition to the uses of the information described above, HOPNBR may, from time to time, collect purchasing information and/or data from other sources. HOPNBR may collect this information for purposes of performing analytics and conducting consumer research. This information may be used to communicate and provide additional information that may be of interest to you and Operators.
In addition, HOPNBR may disclose account or other personal information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interfering with HOPNBR’s rights or property, other App users, Operators, or anyone else who could be harmed by such activities.
4. Altering Information You Submit
(a) In order to comply with applicable laws and regulations, we may be unable to delete information from our databases. However, HOPNBR may alter, modify or delete any information you submit to the App if we believe, in our sole discretion, that it is necessary or desirable to do so.
(b) You may request to stop receiving communications from us by using the “unsubscribe” mechanism in our emails or STOP in text messages. Until you withdraw your consent by unsubscribing or STOPping, HOPNBR may send you emails or texts to alert you to various opportunities or offers available at the App. If you do not wish to receive any offers from HOPNBR, please unsubscribe to remove yourself from our general mailing list.
(c) Operators may push out notifications to you via the App. If you do not wish to receive any notifications from Operators, please disable pushed communications on your mobile device.
HOPNBR uses security technology to protect your data and the data transmissions between you and HOPNBR. Transmission between browsers and our web server is implemented using Secure Sockets Layer (SSL) technology. This technology requires an SSL-capable browser. Although HOPNBR has taken these reasonable and appropriate measures to ensure that your personal information is delivered and disclosed only in accordance with your instructions, HOPNBR cannot and does not guarantee that the personal information you provide will not be intercepted by others and decrypted.
Changes to Privacy Policy
If we make a change to our Privacy Policy in the future that will affect how we treat your information, we will post such change on the App and such change will be deemed to be effective 2 days from the date of such posting. In that case, your ability to opt out of the new policy will be determined by applicable laws.
Business Transfer
We may, in the future, sell or otherwise transfer some or all of our assets or equity to a third party. Your personally identifiable information and other information we obtain from you via the App may be disclosed to any potential or actual third party purchasers of our assets or equity and may be among the assets transferred. We will comply with applicable laws to protect your privacy in the course of any such transaction.
Acceptance
If you do not agree to the terms of this Privacy Policy, please do not provide us with any information and do not use the App. By using the App and voluntarily providing information to us, you consent to our collection and use of the information as set forth in this Privacy Policy.
Links
The App will undoubtedly contain links to other websites or applications that are owned and operated by third parties that are not affiliated with us. When you use those links, you leave the App and we are unable to control how the owners of those websites or applications you link to handle any information they gather about you, including their privacy practices and use of cookies. This Privacy Policy applies only to the HOPNBR App and does not govern activities on linked websites or applications. We encourage you to review the privacy policy of any other website or application you visit, download or access to understand its owner’s practices on how it collects, uses and discloses your information.
